Terms of Service
Effective date: May 31, 2026
These Terms of Service ("Terms") govern your use of NetComTV ("NetComTV", "we", "us", or "our") — the streaming television service available on iOS, Android, Apple TV, and Android TV applications. By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
NetComTV streams live linear television channels, on-demand video, and related content to internet-connected devices. The selection of channels, programs, and features may change at any time without notice. Programming is provided by third parties, and we do not control or guarantee its availability, accuracy, or suitability.
2. Eligibility
You must be at least 18 years old and a legal resident of the United States to create an account or purchase a subscription. By using the Service you represent that you meet these requirements. Accounts created on behalf of a household or business must be activated by an adult who agrees to these Terms on the household's or business's behalf.
The Service is intended for use in the United States. We do not represent that the Service is available, lawful, or appropriate for use outside the United States, and you are responsible for compliance with local laws if you access it from another jurisdiction.
3. Account registration and security
To use most features of the Service you must create an account with a valid email address and password. You are responsible for:
- All activity that occurs under your account, whether or not you authorized it.
- Keeping your password confidential and not sharing it with anyone else.
- Promptly notifying us at support@net-com.tv if you believe your account has been accessed without your authorization.
We may suspend or terminate your account at our discretion if we reasonably believe it is being used in violation of these Terms.
4. Subscriptions, billing, and renewal
4.1 Plans and pricing
The Service is offered on a monthly subscription basis. Plans, channel lineups, and pricing are described in the app and at sign-up. All prices are in U.S. dollars and are exclusive of any applicable taxes or surcharges, which will be added at checkout where required.
4.2 Payment processor
Payment is processed by Stripe, Inc. through Stripe Checkout. NetComTV does not store your full payment card details; those are held by Stripe under their security and privacy practices. You authorize Stripe to charge your selected payment method on our behalf for each billing cycle.
4.3 Automatic renewal
Your subscription renews automatically every month on the same calendar day as your initial subscription (or the last day of the month, where applicable) until you cancel. By subscribing, you authorize NetComTV (via Stripe) to charge your payment method for each renewal at the then-current price.
4.4 Cancellation
You may cancel your subscription at any time through the Stripe Customer Portal accessible from the app's billing screen. Cancellation takes effect at the end of your current paid billing period — you will continue to have access until that date, after which the subscription will not renew and no further charges will be made.
4.5 Refunds
All charges are final and non-refundable, except where required by applicable law. We do not provide prorated refunds for partial-period cancellations, unused content, or service interruptions caused by your equipment, your internet provider, or events outside our reasonable control. We may, at our sole discretion, issue a refund or credit for a billing error.
4.6 Price and plan changes
We may change subscription prices, plan structures, or channel lineups from time to time. Any price increase will be communicated to you at least 30 days in advance by email or in-app notice, and will take effect on your next billing cycle after the notice period. If you do not wish to accept the change, you may cancel before it takes effect.
4.7 Failed payments and suspension
If a payment fails, we may retry the charge in accordance with Stripe's dunning schedule. If a payment ultimately remains unpaid, we may suspend or terminate your access to the Service. You remain responsible for any amounts owed.
5. Devices and concurrent streams
The Service may be used on devices listed in our supported-device list at the time of sign-up. Each plan has a maximum number of concurrent streams as described at sign-up; streaming on more devices simultaneously than your plan permits will result in playback errors or stream interruption. We may impose reasonable per-account device-registration limits to prevent abuse.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any U.S. federal, state, or local law.
- Reproduce, copy, sell, resell, distribute, publicly perform, sublicense, or rebroadcast any part of the Service or its content, except as expressly permitted by the device's standard playback features.
- Circumvent, disable, or otherwise interfere with the Service's security, geographic restrictions, digital-rights-management, watermarking, or other technical-protection measures.
- Share your account credentials with anyone outside your household, or use the Service for commercial public-display purposes (e.g. bars, restaurants, waiting rooms) unless you have purchased a commercial-use plan.
- Use automated means (bots, scrapers, recorders) to access, archive, or extract content from the Service.
- Attempt to access another user's account, reverse-engineer the Service, probe for vulnerabilities, or interfere with the Service's normal operation.
- Use the Service in a manner that could damage, disable, overburden, or impair our servers or networks.
Violation of this section is a material breach of these Terms and may result in immediate suspension or termination of your account without refund.
7. Content and third-party programming
All programming, channels, and on-demand content delivered through the Service is licensed from third parties. We do not produce or independently verify this content. Programming is subject to change, may be blacked out in certain regions, and may become unavailable at any time without notice and without entitlement to a refund or credit. We make no warranty as to the availability, accuracy, completeness, or suitability of any content.
Some content may bear ratings (e.g. TV-MA) and contain material that is unsuitable for minors. You are responsible for supervising minors who use your account and for using any parental controls we make available.
8. Intellectual property
The Service, including its software, design, trademarks, logos, and aggregated channel and content metadata (but excluding third-party content), is owned by NetComTV or its licensors and is protected by United States and international intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service solely for your personal, non-commercial use in accordance with these Terms. No other rights are granted.
9. User-provided data
You retain ownership of any data you provide to the Service (e.g. account email, watchlist, preferences). You grant NetComTV a worldwide, royalty-free, non-exclusive license to use, store, and process that data solely to operate and improve the Service and as further described in our Privacy Policy.
10. Termination
You may terminate these Terms at any time by canceling your subscription and discontinuing use of the Service.
We may suspend or terminate your account at any time, with or without notice, for any reason, including (without limitation) violation of these Terms, suspected fraud, non-payment, or because we have decided to discontinue the Service or a portion of it. On termination, your right to use the Service immediately ceases. Sections that by their nature should survive termination (including Sections 4.5, 6, 8, 11, 12, 13, 14, and 15) will survive.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NETCOMTV AND ITS LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the Service will be uninterrupted, secure, error-free, or free of viruses or harmful components, or that any content will be continuously available. You use the Service at your own risk.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NETCOMTV AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST GOODWILL, OR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages; in those jurisdictions, our liability is limited to the smallest extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless NetComTV and its officers, directors, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of: (a) your use of the Service in violation of these Terms; (b) your violation of any law or the rights of any third party; or (c) any content or data you submit to the Service.
14. Dispute resolution; arbitration
Please read this section carefully — it affects your legal rights.
14.1 Informal resolution
Before filing any claim, you agree to first contact us at support@net-com.tv and attempt to resolve the dispute informally. If we are unable to resolve it within 60 days, either party may proceed under Section 14.2.
14.2 Binding arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service (a "Dispute") that cannot be resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Miami-Dade County, Florida, or remotely at the arbitrator's discretion. The arbitrator's decision will be final and binding. Judgment on the award may be entered in any court of competent jurisdiction.
14.3 Class-action waiver
You and NetComTV each waive the right to bring claims as a class representative, class member, or in any representative or consolidated proceeding. Disputes must be brought on an individual basis only.
14.4 Exceptions
This Section 14 does not preclude either party from (a) bringing an individual claim in small-claims court, or (b) seeking injunctive or equitable relief in a court of competent jurisdiction to protect intellectual-property rights.
14.5 Opt-out
You may opt out of this arbitration agreement by sending written notice to support@net-com.tv within 30 days of first accepting these Terms. The notice must include your name, account email, and a clear statement that you opt out of arbitration. Opting out will not affect any other provision of these Terms.
15. Governing law
These Terms and any Dispute arising under them are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, and by applicable U.S. federal law. The exclusive venue for any claim not subject to arbitration is the state or federal courts located in Miami-Dade County, Florida, and the parties consent to the personal jurisdiction of those courts.
16. Changes to these Terms
We may modify these Terms from time to time. Material changes will take effect 30 days after we post the updated Terms at this URL or notify you by email or in-app notice, whichever is earlier. Non-material changes (e.g. typo fixes, clarifications, contact-info updates) may take effect immediately. Your continued use of the Service after the effective date of a change constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Service and cancel your subscription before the change takes effect.
17. Miscellaneous
- Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and NetComTV regarding the Service and supersede any prior agreements.
- Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect, and the invalid provision will be modified to the minimum extent necessary to be enforceable.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign or transfer these Terms or your account. We may assign these Terms to an affiliate or successor in connection with a merger, acquisition, or sale of assets.
- No third-party beneficiaries. These Terms do not create any third-party beneficiary rights.
- Notices. Notices to you may be sent to the email address associated with your account or posted in the app. Notices to us must be sent to support@net-com.tv.
